Invalidity Search on Patent in Packaging Domain

The Challenge

An Individual Inventor Approached Analystoserve to Conduct an Invalidity Search on Independent Claims for Two Patents in Packaging Domain. The inventor had a product in packaging domain and was not able to market as the product features were overlapping with the two subject patents.

The Solution

The claims of the two patents in question were studied and an in-depth search was performed by the Analystoserve team to identify results relevant to the subject patent claims. The patent literature, non-patent specifications and products were searched for any evidence of invalidating the subject claims. For performing a comprehensive patent search, various strategies were used that included keyword-based searches, IPC/USPC-based searches, assignee/inventor-based searches, and citation-based searches in order to determine references within the extant literature on the topic. File wrapper analysis was also carried out so as not to miss any relevant results. Our analysis identified 3 results that could be used for invalidating the subject patent. The results were presented in an easily understandable and palatable visual format using claim charts that helped in studying and substantiating each element of the subject claims.
